dhami: Uttarakhand CM vows uniform civil code if BJP returns to office | India News – Times of India

DEHRADUN: Uttarakhand CM Pushkar Singh Dhami on Saturday announced that if voted to power, the BJP government would “implement a uniform civil code (UCC) in the state, providing equal rights to all irrespective of their faith”.
While campaigning in his constituency, Khatima, Dhami said that “soon after the swearing-in, the new BJP government would form a committee to prepare a draft for the UCC”. He said the UCC would provide a legal framework for issues regarding marriage, divorce, land, property and inheritance for people of all faiths. It would enhance social harmony, strengthen women empowerment and end all kinds of gender injustice, he added.
Reacting to the announcement, Uttarakhand Congress spokesperson Garima Dasauni said, “Sensing a major defeat, Dhami has made this announcement. Was the BJP government in a state of slumber for the last five years? Why was the UCC not implemented between 2017 and 2022?”
On the question whether states can promulgate UCC on their own, Uttarakhand high court advocate Kartikey Hari Gupta told TOI, “Article 44 says that the ‘State’ shall endeavour to secure for the citizens a uniform civil code and according to Article 12, ‘State’ includes the government and Parliament of India and the government and the legislature of each of the states and all local or other authorities within the territory of India or under the control of the government of India. Therefore, both central and state governments are duty-bound to ensure UCC for citizens.”
