A bench of Justices B.R. Gavai and K.V. Vishwanathan allowed Sisodia’s bail plea in both the Central Bureau of Investigation-CBI and Enforcement Directorate (ED) cases. The court said that keeping Sisodia in custody for a longer period in the hope of speedy disposal of the investigation would be a serious violation of his fundamental right to personal liberty under Article 21.

The court also said that the petitioner had deep concerns with the society. Therefore, there was no danger of Sisodia fleeing. Most of the evidence related to this case, which has already been collected, is of documentary nature, so there was no possibility of tampering with it. The two-judge bench had reserved the verdict on August 6. This bench did not agree with the conclusion of the trial court and the High Court that Sisodia was responsible for the delay in the trial.

The court has asked Sisodia to furnish a bond of Rs 10 lakh and two sureties of the same amount and surrender his passport.

The CBI arrested Sisodia on February 26 last year under the Anti-Corruption Act, while the ED arrested him on March 9 this year under the Prevention of Money Laundering Act.

Aam Aadmi Party leaders have praised Manish Sisodia for getting bail today. Delhi Minister Atishi has called it a victory of truth and the people of Delhi. She said that Sisodia has been implicated in a false case. Ms. Atishi said that the party is now waiting for Delhi’s popular Chief Minister Arvind Kejriwal to also come forward. Delhi Minister Saurabh Bhardwaj expressed happiness, calling it an important moment for Indian democracy. Aam Aadmi Party’s Rajya Sabha MP Raghav Chadha and Lok Sabha MP Sanjay Singh have also expressed happiness over Sisodia getting bail.
